First District Court Report

It was busy Monday for Wrangell’s First District courtroom as a number of cases found resolution – and a number were bound over for further action after the New Year.

Sean A. Barclay, 27, of Sitka, was sentenced to 3 days in jail, 12 months of probation, and an aggregate fine of $1,750 after entering a plea of guilty to DUI and driving without a valid license.

According to court documents, Barclay’s BAC was .146 when he was arrested – nearly twice the legal limit in Alaska.

Judge Kevin Miller dismissed charges of possessing a weapon while intoxicated, though Barclay was ordered to surrender the firearm and ammunition discovered in his vehicle during the DUI stop.

Barclay will also be required to seek treatment and utilize an Ignition Interlock Device for 6 months when he regains driving privileges.

Justin G. Hoff, 23, of Elma, Wash., entered a change of plea in an assault case and was sentenced by Judge Miller to 70 days in jail, with a $700 fine.

Hoff was also ordered to serve 2 years of probation, no use of alcohol, and no contact with his victim. The additional conditions came after Judge Miller took into account three of Hoff’s prior serious felony convictions from out-of-state.

Facing a presumptive minimum of 3-5 years in prison, Russell Z. Shilts, 25, of Wrangell, sought successfully to have his sentencing hearing moved to Jan. 23 at 2:00 p.m. in order to give his attorney time to seek out a treatment program for him.

Public defender Michael Pate asked Judge Miller to give Shilts the additional time to seek out mitigating circumstances in the case and to look into the viability of an inpatient treatment program. Jean Seaton, the prosecutor in Shilts’ case, added that she would oppose any release into treatment.

The arraignment on a petition to revoke the probation of Carl J. Guggenbickler, 23, of Wrangell, was put over until Jan. 23. According to court documents Guggenbickler is currently residing outside of the borough in a halfway house.
