Wayne G. Myers, 29, appeared before First District Court Judge Kevin Miller on the charge of Theft 3, a Class A misdemeanor. The defendant pleaded guilty, and as part of an agreement five counts of Theft 4 – Less than $250 were consolidated into the Theft 3 count for disposition and dismissed. Myers was ordered to serve 12 months with 10 suspended, with the unsuspended time to be served with credit for

time served. He was also ordered to pay restitution of $1492.20 to Bob’s IGA and $100 in fines and surcharges and as part of Myers’ probation is ordered not to have contact with the business for three years.

Marline R. Fain, 59, appeared before First District Court Judge Kevin Miller for Driving Under the Influence, a Class A misdemeanor. The defendant pleaded guilty to the charge and was ordered to serve 30 days with 27 suspended with credit for time served, undergo treatment, and to pay fines, fees and surcharges of $1,955. Fain has had her driver’s license revoked for 90 days, and will have to use an ignition interlock device for six months after regaining her privileges. Fain was also charged with one count of Violate Condition of Release, a Class B misdemeanor. She defendant pleaded guilty to that charge, and was ordered to serve five days in jail

consecutive to her other time and to pay a $50 police training surcharge.

Monday, February 22

An uncontested filing for divorce between Steve Johnson and Frea Johnson was approved by First District Judge Kevin Miller. Property and debts were awarded as set forth in the findings of fact and the wife’s name was restored to Frea Hillaire.
